Nonprofit organizations are different from businesses and government.

To be effective, you must understand what it means to be a nonprofit and how that differs from being a for-profit. before you start the paperwork process.

You can complete the entire process yourself if you are prepared to go through the learning curve or engage the services of someone with expertise in forming, leading, managing and governing nonprofits. While it may be useful to engage the services of a lawyer for complicated situations, the average experience does not require a lawyer – just someone with solid experience in the nonprofit sector.

A Texas Nonprofit Corporation is created by filing a Certificate of Formation with the Secretary of State.  While this results in certain benefits which nonprofits enjoy in Texas, it does not provide the IRS Section 501 (c)(3) status that allows for tax deductible charitable contributions to be made to the organization.  The 501 (c)(3) status is an Internal Revenue Service designation which is granted by the Federal government.
